Before you hand over keys to a foreign tenant, there is one check the law cares about more than references or payslips: whether the person is in Singapore legitimately. If you rent to someone who is not, the landlord can be the person who faces the charge. This page covers how the official checks work, where each pass is verified, the penalties ICA and the Immigration Act state, and what HDB adds. For income, references and the personal data side of screening, see how to screen tenants. For HDB's quota on non citizen tenants, see the HDB non citizen quota guide. This is general information, not legal advice.
Why a pass check is a legal check
Section 57(1)(d) of the Immigration Act 1959 makes it an offence to harbour a person in three situations: where you know they have acted in contravention of the Act or its regulations, where you act with reckless disregard as to whether they have, or where you negligently fail to ascertain whether they have. The penalties in section 57(1AA) differ by limb. For knowing or reckless harbouring, the Act provides imprisonment of a presumptive minimum of not less than 6 months and not more than 2 years, plus a fine not exceeding $6,000. For the negligent limb, it provides a fine not exceeding $6,000 or imprisonment not exceeding 12 months, or both.
ICA's media release of 11 February 2026 states the same figures. It also says those who wish to rent out their premises must exercise due diligence in checking the immigration status of prospective foreign tenants, and sets out three mandatory checks. Whether any particular facts amount to an offence is for the courts, and I cannot say how a case would turn out. What this page can do is describe the checks the authorities themselves name.

ICA's three mandatory checks
| Step | What ICA says | What it means in practice |
|---|---|---|
| 1 | Check the tenant's original immigration or work pass | See the card itself, not a photo or a screenshot sent by message |
| 2 | Cross check the particulars on the pass against the original passport | Name, date of birth and numbers should match, and the person should match the photo |
| 3 | Verify the validity of the pass with the issuing authority | MOM for work passes, and ICA for immigration passes such as the Student's Pass and Long Term Visit Pass |
Step 3 is the one people skip, because a card can look genuine and still have been cancelled. MOM says the same on its work pass FAQ, which lists landlords renting a room to a foreigner among those who should ensure the prospective tenant is in Singapore legitimately.
Where each pass is verified
For work passes, MOM tells you to inspect the original card, and says to check that the photo matches the pass holder and that two holographic lenses behave as described: one reflects the pass holder's image, and the other, when tilted, shows the FIN for Employment Pass holders or the work pass number for Work Permit and S Pass holders. The details on the card should match the original passport. MOM then offers three ways to check validity.
- SGWorkPass app. View the digital work pass card, or scan the QR code on the card or on the pass holder's digital work pass.
- MOM's web service. Check work pass and application status. Enter the date of birth followed by the FIN or passport number. MOM's page says landlords and agents acting for landlords can use it, and that results can be saved as a PDF with the date and time of the enquiry stamped on it.
- Phone. MOM's interactive voice response system.
For citizens and permanent residents, CEA's guidelines say to check the original NRIC and the photograph against the person face to face, and to verify the NRIC with ICA. For Student's Passes and Long Term Visit Passes, which are ICA's, those guidelines say to verify with ICA, or through FileSG for digital passes, noting that only digital long term passes have been issued since 27 February 2023, while earlier physical cards remain valid until they expire or are cancelled. They say to keep copies of the screen capture or acknowledgement slip.
Those CEA guidelines are written for property agents. They also say the amended Women's Charter requires landlords to conduct identity checks at the point of signing the lease, so the identity step applies to citizens and permanent residents as well as foreigners.

How much validity is enough
The two systems use different tests, so it depends on the type of home.
- Private property. CEA's checklist for landlords says that for non residents you must verify the name, passport number and the validity of the pass, with a validity period of at least 3 months. It lists the Employment Pass, S Pass, Work Permit, Student's Pass, Dependant's Pass and Long Term Visit Pass. That checklist is version 1.1, updated 18 November 2020.
- HDB flat. HDB says non citizen tenants must hold Employment Passes, S Passes, Work Permits, Student Passes, Dependant Passes or Long Term Social Visit Passes with a validity of at least 6 months as at the date of the application, tourists are not allowed, and Work Permit holders from the construction, manufacturing, marine and process sectors must be Malaysians. If you rent to a company for its employees, each employee must meet these conditions.

An illustration with assumed dates
These dates are invented. A tenant's Employment Pass shows an expiry of 28 March 2027, and the lease would run 12 months from 1 November 2026. For a private condo, the pass has nearly five months of validity at signing, which meets the checklist's minimum of three months. The pass will still expire in the middle of the lease, so the landlord should diarise it. The CEA template has the tenant produce evidence of renewal or extension of lawful stay before it expires, and warn the landlord in writing 14 days before any change in immigration or employment status.
If the owner of an HDB flat applied to HDB on 6 November 2026 to rent to the same tenant, HDB's test of at least 6 months validity at the date of application would require the pass to run to at least 6 May 2027. An expiry of 28 March 2027 would fall short. It shows why the answer depends on the type of home, and why you check the expiry date, not only that the pass is currently valid.
Everyone who lives there, not only the tenant who signs
CEA's guidelines say the checks apply to each tenant and each occupier, and that if the tenant or occupier changes during the tenancy the same checks apply to the new person. CEA's tenancy template makes the tenant responsible for personally verifying the occupiers' papers and for producing originals to the landlord if asked, but it does not take the duty away from you. If a flatmate moves in mid lease, treat it as a new check.
Keep the records, and keep them safe
CEA's guidelines expect agents to keep copies of the pass, the passport and the verification, and agents' firms retain them for at least 5 years. As a self managing landlord there is no such rule for you that I could find, but keeping the same set is the way to show later what you checked and when. Treat those copies as personal data: store them securely, share them with no one who does not need them, and delete them when you no longer have a reason to keep them. For the data protection side, see the screening guide.
A checklist before you sign
- See the original NRIC, pass and passport for every tenant and occupier, and match the photos.
- Verify each pass with MOM or ICA on the day, and save the result.
- Check the expiry date against the lease end date and, for HDB, against the 6 month test.
- Put an immigration status clause in the tenancy, as in the CEA template.
- Diarise the expiry and ask for renewal evidence before it falls due.

Frequently asked questions
What three checks does ICA say landlords must carry out on a foreign tenant?
ICA says to check the tenant's original immigration or work pass, cross check the particulars on the pass against the original passport, and verify the validity of the pass with the issuing authority. That is MOM for work passes and ICA for immigration passes such as the Student's Pass and Long Term Visit Pass.
What penalties does ICA state for harbouring an immigration offender?
ICA states that recklessly or knowingly harbouring overstayers or illegal immigrants can bring imprisonment of not less than six months and up to two years plus a fine of up to S$6,000. Negligent harbouring can bring a fine of up to S$6,000, imprisonment of up to 12 months, or both.
How can a landlord check that a work pass is valid?
MOM lists the SGWorkPass app, its Check work pass and application status web service, and a phone system. MOM says landlords and agents can use the web service, and the result can be saved as a PDF stamped with the date and time. MOM also says to inspect the original card and match it to the passport.
Does HDB require a minimum pass validity for tenants?
Yes. HDB says non citizen tenants must hold a valid Employment Pass, S Pass, Work Permit, Student Pass, Dependant Pass or Long Term Social Visit Pass with a validity of at least 6 months as at the date of application. Tourists are not allowed. CEA's checklist for private homes uses at least 3 months.
