Can I rent out my HDB flat or a room in it?

Quick answer: Yes, but the rules differ. After your 5 year MOP, you can sublet a room without HDB approval as long as you keep living in the flat. Subletting the whole flat needs explicit HDB approval and MOP completion. Rental income is taxable either way, and short term rentals like Airbnb are illegal for HDB flats regardless.

Owning the flat does not mean you can rent it out however you like. HDB layers different rules on room subletting versus whole flat subletting, and the penalties for getting it wrong are severe.

Occupancy and nationality caps

Maximum occupancy is 6 persons for 3 room flats and 8 persons for 4 room and larger flats, family and tenants combined. Non Malaysian foreign tenants are subject to nationality quotas: 4 room and larger flats may house up to 4 non Malaysian foreigners, 3 room flats up to 2.

Tax and enforcement

Rental income is taxable under Section 10(1)(f) of the Income Tax Act, with legitimate deductions available. Illegal subletting, Airbnb style short term stays, exceeding occupancy caps, or failing to register tenants, can result in HDB exercising compulsory acquisition of the flat, a severe and real penalty.

After MOP, typical net yield for a 4 room flat runs 3.0 to 3.5% after tax and costs, closer to 2.8% in Queenstown and Bishan due to higher valuations.
